Depends on the prosecuting DA I think. Often they will accept a guilty plea in return for taking the death penalty off the table (plus it saves the time and money involved in a trial). If the DA doesn't want to offer a plea deal then it's down to the judge doing the sentencing. |  |

I'd have thought pleading not guilty would have them saying there's no remorse so the death penalty is asked for. Nit that I know much about American law. If he asks for a plea deal he may get a full life senetence but to be honest, the thought of spending all that time, possibly 60-70 years in prison, would have me wondering if I'd rather be dead. |  | |  |
