For the second day running planned return flights for a small number of illegal immigrants did not go ahead after applications to the High Court. A lawyer acting for an Eritrean man argued that he would face "a real risk of destitution" if sent back to France.

According to other media reports several migrants detained with a view to return under the scheme were released from custody after the Home Office received lawyers' letters.

The HRA was a decent piece of legislation, but our adversarial criminal justice system has totally twisted and undermined what it was intended it. The HRA enshrines the right to a fair trial.. nothing wrong with that or many of the other Articles.

It needs a radical revamp, the basic concepts such as Article 2,3,4 , 6,7,9,10,11, should in my opinion be absolute.

Articles 5, 8 and 12 should be qualified rights, - if you aren’t here legally you shouldn’t be able to rely on the right to liberty, a private or family life. Under certain circumstances I’d also remove the right to marry. Bring in those changes and we may be able to get something we can work with. There’s in no way a foreign national sex offender (or one of their family) should be able to argue that their rights under Article 8 are being breached etc when we’re taking steps to deport them because their presence isn’t conducive to the public good. If someone breaks the law, they should be expected to to be deported - end of.

Article 5: Right to liberty and security
Article 6: Right to a fair trial
Article 7: No punishment without law

Article 10: Freedom of expression
Article 11: Freedom of assembly and association
Article 12: Right to marry and start a family
Article 14: Protection from discrimination in respect of these rights and freedoms
Protocol 1, Article 1: Right to peaceful enjoyment of your property
Protocol 1, Article 2: Right to education
Protocol 1, Article 3: Right to participate in free elections
Protocol 13, Article 1: Abolition of the death penalty


The problem is most people have heard of the HRA, but they don’t actually know anything about it and they just read the guff in the Daily Express.

As a general comment on asylum claims, some asylum seekers (maybe a large number, I don't know) whose claims failed in various EU countries have then come across to the UK on small boats making a second asylum claim here.

When they failed their claim in the EU they were fingerprinted to prevent them coming back. When they claim in the UK we don't have access to the EU fingerprint database because we're not in the EU.

So we have to go through the whole process again whereas if we were still in the EU .......

Here's a farcical one a Bangladeshi migrant 59 years of age was given a 1 bedroom flat in a over 55s complex, has now moved his 28 year old wife and twin 3 year old daughters in.

All on benefits and he can't be removed because it would breach his human rights.

Oh he's been living here since 1997 British passport holder and can't speak English

Forgetting the politics, if we wanted to stop a few rubber boats, it is a small stretch of water that could be covered quite easily by a decent number of small naval craft.

I seen a post on social media saying the Welsh flags in Treorchy (predating the latest English nationalists flying flags, which they tried to claim as supporting their movement) was probably in support of keeping the boat people out the tweet said and went on to mention Anglo Saxons and Norman's, the E word wasnt mentioned but no doubt that was what was meant, made me smile, perhaps I shouldn't have but I thought the irony of it was funny.

Even with Afghans the picture seems complicated. I think most UK people would like to help Afghans who have put themselves at risk by assisting the UK armed forces, but there are allegations that the system is being gamed by some migrants who seek to come to the UK for a better life rather than safety. It seems that some are returning for holidays.

Some people see them as traitors to their own people, helping the British against Afghans for money and we are letting people like than in here, if Israel or Russia offer them money to work for them against our interests would some of them do it ?, it's a concern.

Our most valuable asset in protecting the UK has always been since 1069 (don't count that little incursion in Fishguard in 1797 ) the fact we're an a island, now its proving to be our weakness . Mainland Europe has the benefit of having solid borders ,such as Poland and Hungary who are showing the way on how to deal with this invasion and it is an invasion of the West ,looking at how Sweden ,one of the safest country's in the world has now become the bombing capital of europe ,look at the problems in Ireland but at least the people there are not taking it lightly with protests throughout the land.
