Court rules asylum seekers must be moved from hotel ... on 10:30 - Aug 23 by Boundy | I think you'll find the UK government is struggling to confirm or deny the "assistance" these particular afghans gave UK forces . |
Well the MOD don't seem to think they helped them, they're "entitled persons" with indefinite leave to stay.
Court rules asylum seekers must be moved from hotel ... on 07:49 - Aug 29 with 1550 views | AnotherJohn | The big issue emerging in the Epping appeal hearing is whether the UK’s ECHR treaty obligation takes priority over domestic law. I notice this aspect does not feature in the reports appearing in the Independent and Guardian, which instead highlight the argument about the likelihood of further protests which will affect the government's ability to enact policy. In documents submitted to the court Home Office lawyers stated: “Epping represents the public interest that subsists in planning control in its local area. (...) The [Home Secretary] is taken for these purposes as representing the public interest of the entirety of the United Kingdom and discharging obligations conferred on her alone by Parliament. Epping’s interest in enforcement of planning control is important and in the public interest. (...) However, the [Home Secretary’s] statutory duty is a manifestation of the United Kingdom’s obligations under article three ECHR, which establishes non-derogable fundamental human rights.” The Home Office argues that “relevant public interests in play are not equal” and “are fundamentally different in nature”. Stephen Kinnock said contradictory things when interviewed about this on Times Radio today. He said that the views of local people and their community had to be listened to, but that for pragmatic reasons the Government had to make the appeal. The problem is that the appeal verdict will establish a precedent. If the judges rule that international law takes priority over domestic law that is very significant and in my view highly negative for the British people. [Post edited 29 Aug 8:06]

Court rules asylum seekers must be moved from hotel ... on 08:02 - Aug 29 with 1541 views | Dr_Winston | Just in case anyone thinks I might be over egging my belief that a captured judiciary are part of the problem, at least one member of the panel of judges reviewing this case, Lord Justice David Bean, has strong Labour links as a former chair of the Fabian Society. People who have been or are part of political organisations should be barred from being Judges. [Post edited 29 Aug 8:05]

Thanks for posting, it really is worth digging around on issues to really understand what is going on. To say the judiciary is really independent of the Government is getting tested these days. Bean, Davies and Cobb don't seem to be independent?

I dare say if you do much digging around the backstory of any judge who interfered politically with the operations of the last Government you will find Labour or "progressive" links with a lot of them. As I've said before, it was a deliberate policy of New Labour to put as many of their people into positions where they could do stuff like this.

Court rules asylum seekers must be moved from hotel ... on 12:08 - Aug 29 with 1330 views | Boundy | Not my work ,I just read this on facebook. Email sent to the Home Office FAO of Rt Hon Yvette Cooper MP Dear Home Secretary Your department has appealed the ruling concerning placing migrants in the Bell Hotel in Epping. It could be argued that this is a test case for other migrant hotels in a similar position. The people of Epping and across our country are angry at the sight of illegal migrants being placed in hotels at OUR expense. Home Secretary enough is Enough! Your department, no doubt with your full approval, is arguing that migrants have more rights than residents who live in the area. On what convoluted planet do you and Starmer live on? If this appeal is successful, there will be widespread anger across our country. Edward Cooper KC a lawyer employed by your Government has said the hotel is part of 'critical national infrastructure' and that providing accommodation to asylum seekers is in the 'national interest'. He went on to argue that "there is a national interest in ensuring vulnerable individuals, namely asylum seekers, are accommodated." Are you serious, Home Secretary? We have a duty of care to our own people, for example homeless veterans. How will this look to people who are in desperate need of accommodation if your appeal is successful? Do you really believe that illegal migrants have more rights than British citizens? Our country is already a tinderbox. The last thing we need is for your appeal to succeed. I certainly do not want to see violent protests from either side of the argument. You should be looking at closing these hotels down and taking swift action to deport the migrants who have no legal right to be here. Unless of course you are willing to house an illegal migrant in YOUR property. That would truly be leading by example. I won't hold my breath regarding that. Home Secretary, by your own actions, you have completely misread the mood of the British people. You have learned nothing in the 13 months since you became Home Secretary. I sincerely hope that your appeal fails otherwise we will continue to see illegal migrants being housed in hotels with no clear end in sight. I have never seen a Government so out of touch with the people it claims to represent. Yours sincerely Robert J F Barnes

I notice the Judge partly justified the decision based on the rulings of the ECHR. It will be interesting to see if the full hearing allows the Home Secretary to override planning laws.

Court rules asylum seekers must be moved from hotel ... on 14:43 - Aug 29 with 1217 views | AnotherJohn | As the posters above anticipated, Bean's biases were only too obvious in the judgement he read out. The three appeal judges found the original judgement defective on almost all the points of contention, almost to the point of over-kill. Crucially, in my view, Bean neatly side- stepped the issue of a tension between international law and domestic law by saying that the three judges found the notion of a hierarchy "unattractive", and so this would not be given weight. The weight the Appeal Court gave to the relationship between legal judgements and protests was interesting. The judges suggested that the original verdict made protests, including violent protests, more likely. I'd be surprised if the latest judgment doesn't itself provoke protest. It's only one poll, but Farage is 16 points up on Labour in the latest opinion poll. Starmer has a real problem, his backbench is pulling left and the opinion polls are moving to the right. If Corbyn gets his Jezbollah party going there's even more for Starmer to worry about https://www.markpack.org.uk/155623/voting-intention-opinion-poll-scorecard/

“Jezbollah” gave me a giggle, I’m going to start using that. In all my days I don’t think I’ve ever seen a prime minister and government more universally hated than this lot. Truss, Boris, Sunak and May were all useless and massively out of their depth but there was nowhere near the huge levels of palpable ire that is directed at this mob. And the worst thing possible for Labour and Starmer? Nearly all this anger is coming from their own heartlands. The sort of people expressing this anger are people that normally would be the sort of people who vote Labour. Old industrial areas, seats that would have been unthinkable to have fallen 20 years ago. People are fed up, they’ve had it through the nose and if the government don’t start listening they’ll pay the price at the ballot box.

I would be more worried about civil disturbances at a far higher level than shouting naughty words across the street. Corbyn is a danger to the country.

Starmer is suffering now he can't go anywhere without being heckled with plenty of naughty shouty words aimed in his direction, I've never known a Prime minister and his cabinet hated so much by so many people, none of them will have anywhere to go, when the final whistle gets blown.

Boris as unpopular as he was in a lot of quarters would regularly be seen out jogging or cycling in London. I’m sure there were security watching him somewhere but he was pretty free to go where he wanted. Whereas there always seems to be a massive ring of police officers surrounding Starmer on the rare occasions he has to go anywhere within half a mile of the general public. I wouldn’t want to see him or anyone else get hurt it’s not the way we do things in this country. Would like nothing more than to see him completely and utterly destroyed politically though. The man is a snake.

Is it really worth voting when the power lies with the legal profession?
Court rules asylum seekers must be moved from hotel ... on 18:38 - Aug 29 with 885 views | JACKMANANDBOY | I discovered this afternoon that the ECHR rules that are used to explain the rights of refugees actually applies the all of a country's citizens. In this way we should afford the same services that we provide to refugees to stop them becoming destitute to ANYONE at risk of becoming destitute. For example, ex-servicemen sleeping rough are entitled to the same treatment as a refugee. [Post edited 29 Aug 19:23]
